Jordan Cutler (He/Him)
Jordan Cutler is an experienced civil litigator who resolves claims with efficiency and discretion. He represents both domestic and international insurers and their insured.
Jordan’s years of municipal defence experience allows him to skillfully and strategically navigate complex litigation. His municipal defence experience includes defending claims arising from the state of repair of roadways and sidewalks; as well as the alleged acts or omissions of elected officials, by-law enforcement officers, building inspectors, police officers, paramedics and transport operators.
While the focus of Jordan’s practice is the defence of municipalities and their related agencies, he also has experience litigating insurance coverage disputes and claims in several areas: motor vehicle accidents, fire losses, professional negligence, construction claims, occupiers’ liability, sports and recreation liability, and liquor liability.
Municipal Liability
For the bulk of Jordan’s career, he has defended upper and lower tier municipalities across Ontario in all manners of claims. Of note, Jordan has:
- had a catastrophically injured plaintiff’s claim against a municipality dismissed on a summary judgement motion – Miller et al. v. Canadian National Railway et al., 2021 ONSC 4806;
- successfully defended hundreds of municipalities in relation to multi-million dollar, catastrophic, and/or fatal claims allegedly caused by the state of repair of highways;
- defended police officers and police boards in relation to claims of negligent investigation, wrongful arrest, malicious prosecution, and breach of Charter rights; and
- defended Mayors and other elected officials in relation to claims for misfeasance in public office and economic torts such as intentional interference with economic relations.
Occupiers’ Liability
Jordan regularly defends claims allegedly arising from a breach of a duty owed by an occupier, be the premises a commercial property, residential property, parking lot, recreation complex, pathway, etc. Further, Jordan is experienced in defending claims brought against adjacent property owners who are not occupiers.
Sports and Recreation Liability
Jordan regularly defends claims involving sport and recreation liability. He has acted for both sports organizations and leagues in liability claims arising from all types of injuries, including sexual assault and traumatic brain injuries.
Liquor Liability
Jordan regularly defends nightclubs, restaurants, and taverns in claims arising from the service of alcohol, forcible ejection, and occupiers’ liability.
