Oneal Banerjee (He/Him)

Oneal Banerjee has been practicing insurance and personal injury litigation since 2003. Oneal has represented clients at all stages of the litigation process, up to and including trial, judicial review, and appeal. Oneal’s experience prior to joining Dolden Wallace Folick includes complex insurance, product liability, and government liability litigation as a lawyer at one of the country’s largest full-service national law firms and a leading insurance defence boutique, after Articling at the Crown Law Office – Civil (Ontario).

Oneal has extensive experience defending negligent investigation and wrongful death matters, defending physical assault and sexual abuse claims, and handling product liability complex property and casualty claims, arising from fires and gas explosions.

Oneal’s practice areas include:

Class Action Defence:

  • Currently acting as defence and monitoring counsel in several high profile class actions in multiple provinces in Canada, arising from casualties, abuse, fatalities, and significant property loss

Complex Property Loss:

  • Currently acting as defence counsel in several high value fire and water loss claims for insurers and their insureds
  • Has defended numerous complex fire, water, and gas explosion claims for insurers

Sports and Recreation Liability:

  • Currently acting for several sports organizations in defending complex personal injury claims and claims arising from disciplinary proceedings against members or coaches

Complex Personal Injury:

  • Currently defending several alleged negligence claims against several insured entities arising from fatalities
  • Has defended countless negligence claims arising from catastrophic or life altering injuries on behalf of insurers and their insureds

Civil Sexual Abuse:

  • Has defended sports organizations in claims alleging sexual abuse by coaches arising from alleged negligence of the organizations

Product Liability:

  • Has acted for product manufacturers of automobiles, televisions, toasters, and other products in claims alleging that product defects resulted in catastrophic injury or significant property loss

Occupiers’ Liability:

  • Currently acting for several insured winter maintenance contractors in claims involving complex personal injuries as a result of alleged deficiencies in winter maintenance
  • Has acted for municipalities and other insured occupiers in defending claims relating to recreational trails, sidewalks, parking lots, and other premises alleged to have been kept in unsafe conditions
