Jennifer Guy
Jennifer maintains a broad insurance coverage and defence practice, with significant experience acting for insurers in high-exposure, complex, and multi-jurisdictional matters. She is recognized for her practical, solutions-focused approach and her ability to manage complex, high-value claims with multiple stakeholders.
Jennifer has appeared at all levels of court in Ontario, including as trial counsel. She recently conducted a hearing at the British Columbia Human Rights Tribunal.
Prior to joining Dolden, Jennifer was a partner at a boutique insurance defence firm in Toronto.
Her practice areas include:
COVERAGE
- Providing comprehensive coverage opinions to domestic and international insurers across a wide range of policy lines, including Commercial General Liability (CGL), Professional Liability, Construction Wrap-Up, Directors & Officers Environmental Impairment Liability, Property, Automobile, Excess and Umbrella. She also provides advice relating to specialty coverages such as life insurance agents’ E&O, information technology E&O, multimedia liability, and contractor’s protective liability.
- Advising on long-tail liability, allocation between insurers, allocation between insurer and policyholder, and policy interpretation issues arising in multi-jurisdictional and multi-party disputes.
- Acting as coverage counsel in complex class actions, product recall and manufacturing defect claims, and environmental disaster claims.
MEDICAL MALPRACTICE
- Defending diagnostic laboratories, genetic testing providers, X-ray, CT, ECG and MRI clinics, and student physicians and nurses in relation to missed or late diagnosis, medical errors and birth injuries.
- Representing fertility clinics, specialists, and related healthcare providers with an awareness of heightened privacy concerns and complex medical, legal, and ethical issues involved in wrongful birth and wrongful life claims.
PRODUCT LIABILITY
- Defending product liability claims on behalf of manufacturers, distributors and retailers relating to pharmaceuticals, medical devices, large industrial machinery, and consumer goods.
MUNICIPAL LIABILITY
- Defending municipalities, police boards and school boards in a wide variety of claims including highway maintenance, building inspections, and bus operations.
- Jennifer obtained a zero-liability verdict at trial for a school board arising from a track and field injury.
PROFESSIONAL LIABILITY
- Defending professional liability claims against lawyers, engineers, environmental consultants, and medical aesthetics providers ensuring effective defence strategies tailored to the nuances of professional practice.
CIVIL SEXUAL ABUSE
- Navigating allegations of civil sexual abuse using a trauma-informed approach and promoting alternative dispute resolution.
